FELLA REWARDS | LOYALTY PROGRAM

DEFINITIONS, TERMS AND CONDITIONS

DEFINITIONS


Anniversary date means the last day of your joining month. For example, if you sign up and join Fella Rewards on January 12, your anniversary date will be January 31.


Annual spend is the qualifying spend during your loyalty year period and means a member's net cumulative spend on all full price and sale purchases after all discounts, returns, and other parameters have been applied or subtracted. For example, a member’s cumulative annual spend, if their anniversary date is 31 March, will be calculated on 1 April for the 12-month period prior.


Birthday cards will be issued to an eligible member, if their communication preferences are POST only. Others will receive it via email or SMS. The terms and conditions are as per “Birthday Voucher” in these definitions.


Birthday gift will be issued to an eligible bronze to platinum member and sent via POST. 


Birthday Voucher will be issued to an eligible member, in respect to their relevant tier level 2-weeks prior to birth date for 1-15 of a month and 2-weeks prior to 16-31 of a month. (They are calculated at the time of issue, not at the date of birthday). Vouchers are issued via POST, email, OR SMS, in that order of preference. To receive a birthday voucher, a member must provide their birthday information, (with or without their year of birth), at least six weeks prior to their birthday. No minimum spend applies when utilizing a Birthday Voucher. Voucher valid on full price and sale purchases. The expiry date of the Birthday Voucher is on the last day of the next month. Birthday Vouchers are not retrospective and will not be issued for birthdays that occur prior to becoming a member of Fella Rewards.


Fella Rewards means the loyalty program operated by Fella Hamilton trading as Fellaton 1 Pty Ltd with access by members to rewards in accordance with these terms and conditions.


Free online shipping is available free of charge to Silver, Gold and Platinum Australian members and applied to every order. Free shipping is available to all members and bronze tier members on purchases over $150 online, in-store or over the phone. International orders must be processed online or by Fella Hamilton Customer service over the phone - see https://fellahamilton.com.au/pages/delivery-information for details.


Inappropriate Conduct includes but is not limited to:

  1. a Member misusing the Website including but not limited to:
    • transmitting illegal or improper materials to the Website
    • using abusive language or graphics in messages or post any other material which is malicious, technologically harmful or in any way obscene
    • causing technical harm to the Website including transmitting or disturbing potential threats such as viruses, worms, malicious materials; or
    • committing or encouraging any unlawful activities such as hacking or phishing; or
  1. b)   a Member abusing staff or other customers of Fella Hamilton whether it be in store, over the phone or via email; or
  2. c) a Member engaging in product theft or misusing the Fella Rewards to obtain an ineligible or fraudulent reward.  

Join date means the date a member joined the Fella Rewards program.


Loyalty Reward Voucher refers to vouchers given for Birthday, Festive, and Tier Anniversary.


Member means individuals who sign up and register to the Fella Rewards Program and remain current. See 2. CONDITIONS: Communication, for more information. 


Member profile or login means the details provided by the member. Members must not allow other members or persons to use their member profile.  


Qualifying Spend means all paid purchases excluding shipping charges. Purchases paid for using gift cards, e-vouchers and Loyalty Reward Vouchers are excluded whether made online, instore or over the phone. Tier Spend Balances may not update until the following day. Qualifying spend does not change with the issuing of a credit note, but consequently the payment with a credit note does not count towards qualifying spend.


Rewards are rewards or other benefits, such as free shipping, issued to members of Fella Rewards as a result of purchasing. 


Tier Spend Balance means the members net cumulative spend after all Loyalty Reward Vouchers, etc. have been applied or subtracted on Qualifying Spend whilst they are a member of a tier. Tier Spend Balances may not update until the following day. Tier Spend Balance is in Australian Dollars.


Technical issues may be experienced from time to time and means the malfunction of any online computer systems, congestion and/or technical issues with the internet or website, telephone network, connection or lines, servers, equipment, software, and technical providers.


Transaction In-Store means a purchase made visiting a Fella Hamilton location and making a purchase through point of sale using a valid credit card, debit card, gift card or e-voucher or cash


Transaction Online means a purchase made through www.fellahamilton.com.au using a valid credit card, gift card or e-voucher.


Transaction Over the phone means phoning 1800 800 866 and placing an order to purchase through point of sale using a valid credit card or debit card, gift card or e-voucher.


Website refers to the Fella Hamilton website www.fellahamilton.com.au where purchases can be made, details of the Fella Rewards program are found, including full terms and conditions, where members can log on and view their status, profile and information.

  • GENERAL

    1. These terms and conditions outline how we will deliver the Rewards Program to Members.
    2. Individuals who join Fella Rewards agree to be bound by these terms and conditions.
    3. Terms and conditions can be modified at any time by Fella Hamilton without prior notice and can be applied retrospectively to a member of the program

    5. We do not hold any responsibility or liability for misdirected, lost, or undelivered emails sent to Members
    6. Subject to compliance with the Australian Consumer Law, Fella Hamilton reserves the right to cancel, terminate, modify, or suspend the Fella Rewards Loyalty Program, or amend terms and conditions at any time and at its discretion
    7. Fella Hamilton may collect personal information for the purposes of facilitating the rewards program and its benefits. Personal information will be handled in accordance with the privacy policy, found here [link], and in accordance with the Australian Privacy Principles as applicable
    8. These terms and conditions apply to a member’s participation in all Fella Rewards activities, including but not limited to qualifying loyalty transactions and redeeming any Reward vouchers 
    9. Any additional promotions or offers made by Fella Hamilton within Fella Rewards that are subject to additional conditions, will form part of these terms and conditions.
    10. Fella Hamilton, trading as Fellaton 1 Pty Ltd, decision in relation to all matters arising in relation to Fella Rewards is final and binding.

    MEMBERSHIP

    1. Fella Hamilton can and may request proof of identification for the purpose of authentication of a members membership and in compliance with our terms and conditions
    2. Membership to Fella Rewards is open to individuals who are 18 years or older with a unique individual email address and/or mobile phone number and/or postal address who reside in Australia and any international customers with a valid email address. Excludes rewards by SMS internationally and gifts rewarded as part of the program to international members that only supply email as their communication preference
    3. Individuals become Members of Fella Rewards as at the Join Date
    4. Membership is conferred upon an individual upon signing up in-store, over the phone or online, during a transaction, and/or engaging in activities to earn or redeem Rewards
    5. You may sign up online or in store by completing the required details at registration. Members must ensure their details are current and accurate, and it is their responsibility to do so. Change in details, including but not limited to email address, mailing address, and/or phone number must be completed by members in the membership profile online, in store or over the phone.
    6. Once registered, you will be given a unique customer number in your customer profile, which is personal to the member. Members are not permitted to share or apply for more than one membership. Members must not allow another person to use their customer number at any time.
    7. Your membership is personal and is not transferable
    8. Fella Hamilton  reserves the right to suspend or terminate a Member at any time if, in our reasonable judgment, we believe that the Member has participated in Inappropriate Conduct. (See 1. Definitions for explanation of Inappropriate Conduct)
    9. Fella Hamilton employees are not permitted to become Members of Fella Rewards whilst employed
    10. Members may terminate their membership at any time by providing written notice to sales@fellahamilton.com.au, or in person at a store, or over the phone with customer service. 
    11. You must have valid communication preferences in order to participate and receive Fella Rewards

    COMMUNICATION

    1. Individuals may be signed up to Fella Hamilton, and not be a member of Fella Rewards, if they have declined any form of communication or have provided incorrect or out of date communication preferences. For example, if all communication methods are declined, Fella Hamilton cannot communicate with individuals and thus, no vouchers, gifts or rewards will be received. 
    2. Members of Fella Rewards will receive communication from Fella Hamilton by either email, sms or post as recorded in the relevant members’ profile
    3. When Fella Hamilton must give a member notice of any matter concerning their membership, members agree a communication by post, email or SMS, recorded in the relevant member profile, will satisfy any requirement for ‘written communication’
    4. Fella Hamilton will not accept any liability for any technical issues that may cause damage to any computer related to or used in connection with the Fella Rewards Program or may cause any email communication to any Member to be misdirected, lost or not received. Additionally Fella Hamilton will not accept responsibility for any misdirected, lost or not received post.
    5. Fella Hamilton will not accept any liability for Member details not being correct, current and/or accurate. Any rewards sent to incorrect postal addresses, email addresses or mobile phone numbers will be null and void. 

    FELLA HAMILTON RESPONSIBILITIES

    1. At Fella Hamilton, we strive to offer up-to-date and precise information; however, the currency of information is subject to change, and we may need to correct information and descriptions concerning Fella Rewards or a Member Profile.
    2. To the maximum extent permitted by law, all conditions, rights, remedies, liabilities and other terms implied by law are excluded from these terms and conditions. Fella Hamilton is not responsible to members or anyone else for any loss arising out of the use of Fella Rewards
    3. Subject to consumer law, there are no warranties of any kind (either express or implied) and Fella Rewards is provided on an “as is” basis. We make no warranties or representations as to the operations of Fella Rewards. If there is any liability that cannot be excluded, our responsibility for a Member's use of Fella Rewards is limited to the maximum extent allowed by the Australian Consumer Law. These Terms and Conditions do not restrict your rights under the Australian Consumer Law.
    4. Fella Hamilton is not liable for any tax incurred by a Member in connection with Fella Rewards, including but not limited to that incurred in the provision of vouchers.


    WEBSITE ACCESS

    1. When you signed up to become a member of Fella Rewards, the username and password entered by you is a basic security for your account. The correct use grants you access to your member page on the Website which shows your respective personal information, order and purchase details etc.
    2. Fella Hamilton reserves the right to investigate any such accounts that have been registered on our Website that appear to be misused.. You agree to be responsible for any unauthorized use (e.g. hacking) of your account in terms of the limitations, communication and other obligations acquired in such types of access.
    3. You agree to be responsible for the security of your details entered on your member account. Should you face any issues of breach or misuse of your account, you must inform us as soon as practicable.

    EARNING REWARDS

    1. Fella Hamilton may cancel, terminate, modify or suspend Fella Rewards at any time, or vary the terms and conditions at its absolute discretion
    2. Fella Hamilton may withdraw, cancel or vary any rewards without notice and at any time for any reason in its absolute discretion including without limitation rewards awarded in error or rewards earned fraudulently 
    3. At Fella Hamilton, we strive to offer up-to-date and precise information; however, the currency of information is subject to change, and we may need to correct information and descriptions concerning Fella Rewards or a Member Profile
    4. Fella Rewards operates by attributing different rewards to the various tiers of the Fella Rewards program. Members are allocated a tier according to their Tier Spend Balance
    5. In store, when a Member presents themselves as a member and completes a transaction, or online by logging into their account  and completes a transaction, the net amount of the Qualifying Spend is added to their Tier Spend Balance and may not update until the following day
    6. All rewards are earned in Australian Dollars, regardless of your country of residence
    7. Earning rewards through the use of other rewards (i.e. any reward voucher with a monetary value), is not counted as part of the transaction. For example, the monetary value of a reward used in part or whole payment of a transaction will not count towards a Member’s Qualifying Spend, only the paid purchase amount.
    8. All outstanding and future rewards are no longer valid if Fella Hamilton terminates a membership of Fella Rewards. They will be rendered null and void. 
    9. Members can view their Tier Spend Balance (12-month Qualifying Spend total) online by logging into their account at any time and “request a statement” of Qualifying Spend that contributes to their Tier Spend Balance, and thus their tier level.
    10. All Qualifying spend amounts count towards a members Tier Spend Balance.

    TIERS & REWARDS

    New Member Offer

    $20 off full price purchases over $50.

    This offer is available to select customers after joining Fella Rewards. New members must not have an existing member profile.

    Voucher emailed to online registrations with a code that must be applied at the checkout. In store, a discount of $20 is applied at first purchase. 

    One time only use.

    Valid for 30 days after joining.

    Only available at Fella Hamilton stores, over the phone and online at www.fellahamilton.com.au 

    Not redeemable for cash, to purchase gift cards or e-vouchers, against a layby purchase or prior purchase, such as an order placed prior.

    Unless otherwise stated in this section, the terms and conditions stated under “VOUCHERS & REDEMPTIONS” apply to New Member offer.


    Members are allocated a tier according to their spend balance, as shown below in the table:

    A member may move at any time to a higher tier when their spend balance qualifies them to.


    At the end of their anniversary month, a Member’s status will be determined by their Tier Spend Balance and the Member will, depending on the Members Tier spend Balance either move to a different tier or retain their Member status and the Members Tier Balance will reset to $0. The Member's status will then remain in that tier until the next anniversary date. Members will only drop down one tier, regardless of Qualifying Spend, if that Member spends less than the tier directly down from the current tier.

    Any anniversary vouchers Fella Rewards members are eligible for will be issued within the following month of their anniversary month.

    Birthday Voucher

    A Birthday Voucher will be issued to an eligible member, in respect to their relevant tier level 2-weeks prior to birth date for 1-15 of a month and 2-weeks prior to 16-31 of a month. (They are calculated at the time of issue, not at the date of their birthday). 

    Vouchers are issued via POST, email, or SMS, in that order of preference. 

    To receive a birthday voucher, a member must provide their birthday information, (with or without their year of birth), at least six weeks prior to their birthday and meet relevant spend levels in respect to a tier

    No minimum spend applies to redeem vouchers.

    Valid on full price and sale purchases. 

    Expiry date of the Birthday Voucher is on the last day of the next month

    Birthday Vouchers are not retrospective and will not be issued for birthdays that occur prior to becoming a member of Fella Rewards or before completing the necessary information in their member profile.

    Birthday Gift

    A Birthday Gift will be issued to an eligible bronze, silver, gold or platinum member and sent via POST. 


    Festive Voucher

    A festive voucher will accompany Summer Catalogue 5 and the Reward Voucher amount is as per Members relevant tier, at or around 8 December each year, using Qualifying Spend Amount 

    Reward Vouchers will be mailed to customers. For those Members that do not receive POST, they will receive their voucher via email or SMS.

    Valid for full price and sale purchases.

    Expires 31 January each year.

    No monetary value will be given as change, valid for a single transaction only. 

    Unless otherwise stated in this section, the terms and conditions stated under “VOUCHERS & REDEMPTIONS” apply to Festive Vouchers


    Tier Anniversary Voucher

    Once a Member's Spend Balance qualifies them to move up a tier, a Voucher is given within the following month after their anniversary month to recognise Members leveled up to a new tier. 

    If a customers spend retains them at their current tier within a 12-month period, at the end of their anniversary month, a Voucher is given.

    Members will receive this via email, SMS or POST (in order of preference). 

    Valid for full price & sale purchases. 

    Expiry from issue date relevant to Members tier.  

    Minimum spend required to redeem the voucher. 

    No monetary value will be given as change, valid for a single transaction only.

    Members are able to collect their gift in store or  it will be mailed out with an online or over the phone purchase. 

    Fella Hamilton reserves the right, at our sole discretion, to change, substitute, modify or end the offer of a gift at any time.


    Online Free Shipping

    Applies to all Australian orders over $150 after all vouchers have been redeemed and all discounts have been applied, or Members are silver, gold or platinum status.

     VOUCHERS & REDEMPTION

    1. Fella Hamilton may issue a rewards voucher based on a member’s Qualifying Spend
    2. Notification of a rewards voucher or entitlements will be based on the Members communication preferences
    3. Vouchers cannot be sold, transferred or assigned to another member or party and are not redeemable for cash, including but not limited to gift vouchers, gift cards, or credit & debit cards
    4. Vouchers will be issued in Australian dollars and can only be redeemed in a Fella Hamilton store, online at www.fellahamilton.com.au or over the phone on 1800 800 866
    5. Redemptions of reward vouchers or membership discounts given are not included in the Members Qualifying Spend Total
    6. Reward vouchers can only be redeemed on Qualifying Spend as explained under “Tiers & Rewards” in these terms and conditions
    7. Fella Hamilton reserves the right, at our sole discretion, to exclude specific items and promotions from being redeemed using rewards vouchers
    8. Each voucher released will have clear and defined expiry dates. Vouchers may not be redeemed after the expiry date. However, Fella Hamilton reserves the right to extend the expiry date of any rewards voucher at any time without reason. Expiry dates may be by calendar date or as dictated by a members tier as stated in the table under TIERS & REWARDS
    9. All reward vouchers held by a member whose membership is terminated will be void and unable to be redeemed
    10. Fella Hamilton shall not be held responsible or liable in the event a rewards voucher is not redeemable due to a technical issue. However, in such cases, we will make reasonable efforts to rectify the error and ensure the voucher can be redeemed
    11. Fella Rewards vouchers can only be redeemed once
    12. Fella Rewards vouchers must be redeemed in a single transaction. Credit notes or any monetary value will not be issued for any value unspent
    13. Fella Rewards vouchers cannot be redeemed as payment for any part of a layby purchase
    14. Where items purchased with a rewards voucher are returned or refunded the value of the refund does not constitute an amount for a Member’s Qualifying Spend and the amount will be removed from the Members Tier Spend Balance.
    15. A Fella Rewards voucher is not legal tender in any country other than Australia. 
    16. Fella Hamilton is not responsible for any lost or stolen vouchers, and is not liable to replace any Fella Reward vouchers that are lost or stolen
